Closed on home. Former owner won’t leave.

 In RealEstate

NOTE: In my state, a person does not become a tenant unless they stay at your home longer than 30 days or have a signed lease.

Family friend was selling house due to divorce. Bought home from family friend. Contract stated occupancy at closing. Closing completed. Seller received all money. I received deed in my name. Seller asked for 2 weeks after closing (outside of contract) to move. I said ok but asked for keys at closing to do some measurements for flooring and renovating. I got leys at closing. I told him that I would let him know when I would be down there to measure or do something. He wasn’t living there, but some of his stuff was still there, but not a lot of personal stuff. During these 2 weeks he’s not moved much. Now 2 weeks is almost up and he’s not out! He is telling me that he should have had 45 days (although he signed the occupancy at closing) and saying he going to change the locks and I can’t come down again or he’s going to call the cops and have me arrested for trespassing! Keep in mind the deed is in my name, I had occupancy at closing, utilities are in my name and he gave me the keys at closing. My thought is to go to the house after the 2 weeks are up and change all the locks myself, set anything left of his in the house on the curb, and dare him to call the police, as I think the law would be on my side and charge him with trespassing. What would you do?
